This website is operated by GS Worldwide LLC, a limited liability company registered in Wyoming, United States, of 30 N Gould St Ste N, Sheridan, WY 82801, trading as Beverley Lane. The terms "we", "us" and "our" refer to GS Worldwide LLC.

By visiting this website and/or purchasing from us, you accept these Terms of Service, including any additional terms and policies referenced here or available by link.

These terms apply to all users of the website, including browsers, customers and content contributors.

SECTION 1 · YOUR CONSUMER RIGHTS

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

If you are in New Zealand, the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 apply to your purchase.

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be excluded. If any part of these terms would have that effect, that part does not apply.

SECTION 2 · ONLINE STORE TERMS

By agreeing to these terms you confirm that you are at least 16 years of age.

You may not use our products for any unlawful or unauthorised purpose, nor breach any law in your jurisdiction, including copyright law. You may not transmit worms, viruses or any code of a destructive nature. Breach of any term will result in immediate termination of the services.

SECTION 3 · ACCURACY OF INFORMATION

We are not responsible if information on this website is not accurate, complete or current. The material is provided for general information only and should not be relied upon as the sole basis for a decision.

This site may contain historical information which is not current. We reserve the right to modify the content of this site at any time, but we are under no obligation to update it.

SECTION 4 · PRODUCTS AND SERVICES

Certain products may be available exclusively online and in limited quantities. All items are shipped directly to the consumer from our supplier in Asia.

We have made every effort to display our products accurately, including fabric composition, measurements and country of origin. We cannot guarantee that your monitor's display of a colour will be accurate.

Any offer of a product or service made on this website is void where prohibited.

SECTION 5 · PRICES AND FORMATION OF CONTRACT

Prices are shown in Australian dollars and include any tax we are required to charge. Standard delivery is free.

By clicking 'Complete order' you place a binding order. The contract is formed at that moment, subject to our right to cancel under Section 6. The order confirmation email records the contract; it does not create it.

The price that applies to your order is the price displayed at the time you complete your order. We do not change the price of an order once it is placed. Prices on the site may change at any time before you order.

Because the contract is formed when you complete your order, processing for dispatch begins immediately. Cancellations and changes to an order are dealt with in our Refund Policy, and are subject to the time limits and the cancellation charge set out there.

SECTION 6 · ORDERS AND BILLING INFORMATION

We may cancel an order after it is placed where the item is unavailable or discontinued, where there has been a genuine pricing or description error, where we reasonably suspect fraud or a payment is declined or reversed, where we are unable to deliver to your address, or where you are in breach of these terms. Our right to cancel in these circumstances is a condition of the contract formed under Section 5.

If we cancel your order, we refund you in full, including any delivery charge, to your original payment method, and we will notify you. No cancellation charge applies where the cancellation is ours.

Where you ask to cancel an order, our Refund Policy applies, including the time limit for cancellation and the cancellation charge.

You agree to provide current, complete and accurate purchase and account information, and to update it promptly.

SECTION 7 · PAYMENT

We accept the payment methods shown at checkout. Payment is processed by third-party providers over an SSL encrypted connection. We do not store your full card details.

SECTION 8 · DELIVERY, CANCELLATIONS AND RETURNS

Delivery times, shipping costs and customs charges are set out in our Shipping Policy. Returns, refunds, exchanges, cancellations and the treatment of parcels that are refused or not collected are set out in our Refund Policy. Both form part of these terms.

Risk in the items passes to you on delivery.

SECTION 9 · OPTIONAL THIRD-PARTY TOOLS

We may provide access to third-party tools over which we have no control. You acknowledge that these are provided "as is" and "as available" without warranties or endorsement from us. Any use of optional tools is at your own risk.

SECTION 10 · THIRD-PARTY LINKS

Certain content, products and services available through our service may include material from third parties. Links on this website may direct you to external sites not affiliated with us.

We are not responsible for examining or evaluating the content or accuracy of third-party websites. Complaints regarding third-party products should be directed to that provider.

SECTION 11 · COMMENTS, FEEDBACK AND SUBMISSIONS

If you send us comments, reviews, photographs or other material, you agree that we may edit, copy, publish, distribute and use them in any medium, and you confirm that the material is yours to send and does not infringe the rights of any third party.

We will not use a photograph or video of you in our advertising, on our website or on our social media unless you have given us separate permission. You may withdraw that permission at any time.

We may remove content that is unlawful, misleading, abusive or infringing.

SECTION 12 · PERSONAL INFORMATION

The submission of personal information through the store is governed by our Privacy Policy, which forms part of these terms.

SECTION 13 · MARKETING

We send marketing emails and texts only to people who have opted in. Every marketing message identifies us and includes a free unsubscribe option, actioned within 5 business days. Messages about an order you have placed are not marketing and will still be sent.

SECTION 14 · PROHIBITED USES

You are prohibited from using the website or its content for any unlawful purpose; to encourage unlawful activity; to breach any regulation, rule or law; to infringe our intellectual property rights or those of others; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload or transmit malicious code; to collect or track the personal information of others; or to interfere with or circumvent the security features of the service.

We reserve the right to terminate your use of the service for breach of any prohibited use.

SECTION 15 · LIABILITY

Nothing in this section excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law, the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law: we do not warrant that your use of the service will be uninterrupted, timely, secure or error-free; the service is provided "as is" and "as available"; we are not liable for indirect or consequential loss; and our total liability in connection with these terms and any order is limited to the amount you paid for the items concerned.

Nothing above limits our responsibility for loss caused by our failure to meet a consumer guarantee, or for death or personal injury caused by our negligence.

SECTION 16 · GOVERNING LAW, CHANGES AND GENERAL

Governing law. These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales. If you are a consumer in New Zealand you retain the benefit of New Zealand's mandatory consumer protection laws and your right to bring a claim in New Zealand. If you are a consumer in Australia you retain your right to bring a claim in the state or territory where you live.

Changes to these terms. We may update these terms from time to time. The terms that apply to your order are the terms in force at the moment the contract was formed — later changes do not apply retrospectively. The current version is always available on this page.

Severability. If any provision is found to be unlawful, void or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.

Entire agreement. These terms, together with our Refund Policy, Shipping Policy and Privacy Policy, constitute the entire agreement between you and us governing your use of the service.
